WHAT IS SENATE BILL 36?

Kentucky's kids should be treated like kids, not adults. Children who are engaged in the legal system need access to community programs, trauma-informed counseling, and equitable education. Senate Bill 36 would end the automatic transfer of children to adult court for some offenses. The human brain is not fully developed until roughly 25 years of age. We must give our young people the support and resources they need to heal and move forward.

Senate Bill 36 would also address racial disparities in the legal system. According to WLKY, "of the 483 cases closed in 2020 in which juveniles were tried as adults, 53% of the defendants were Black, according to data from [Kentucky's Administrative Office of the Courts]. Only eight percent of Kentucky's population is Black, according to the most recent U.S. Census estimate."
