Pending without litigation.  The ACLU of Kentucky is representing Tanja Medic, a young woman from Bosnia who now lives in Louisville, in her application to take an alternative naturalization oath. Ms. Medic is a permanent resident alien who has met all requirements for United States citizenship. Her only remaining step is to take the Oath of Naturalization, which requires new citizens to swear to bear arms on behalf of the United States. Ms. Medic is a conscientious objector and hence objects to the requirement that she swear to bear arms, although she is willing to perform noncombatant service on behalf of the United States. Unlike many conscientious objectors, Ms. Medic is not a religious person. Rather, she came to view war as immoral after growing up in the aftermath of World War II, and her belief was strengthened all the more as a consequence of witnessing the Bosnian War first hand. In our application, which is pending, we cite federal court cases clarifying that one need not be religious to be a conscientious objector and hence Ms. Medic should be allowed to take the alternative naturalization oath.
