United States District Court. The ACLU of Kentucky is representing Amber Jewell, a student at Apollo High School in Daviess County, who has been refused the right to wear a t-shirt to school bearing a picture of an antique tractor with a Confederate flag in the background. Federal courts prohibit public schools from banning student expression unless the school has reason to predict that the expression will cause material and substantial disruption at school. In addition, the Sixth Circuit appeals court makes clear that even where student expression can be regulated, it must be regulated in a viewpoint neutral manner.
